1.2 OpenEarn operates a digital platform that enables users to view advertisements, earn digital tokens, utilize such tokens for artificial intelligence services, and contribute computational resources through decentralized infrastructure associated with the OpenGPU Network (the "Services").

1.3 This Privacy Policy describes how OpenEarn collects, uses, processes, stores, and otherwise handles personal data in connection with the Services.

1.4 By accessing or using the Services, including by creating an account, the user acknowledges that they have read and understood this Privacy Policy and agree to the processing of their personal data as described herein.

2.1 OpenEarn operates globally and may process personal data of users located in multiple jurisdictions.

2.2 Depending on the user's place of residence, personal data processing may be subject to the Swiss Federal Act on Data Protection (FADP) and, where applicable, the European Union General Data Protection Regulation (GDPR).

3.1 Flowstate Capital GmbH acts as the sole data controller for the processing of personal data under this Privacy Policy.

4.1 OpenEarn collects and processes personal data that is necessary for the provision and operation of the Services.

4.4 OpenEarn processes data relating to user activity within the platform, including interactions with advertisements, accumulation and use of tokens, and general usage data required for system functionality.

4.5 OpenEarn may also process limited technical data, including system logs, access records, and security-related information.

4.6 OpenEarn does not create user profiles and does not engage in behavioral profiling.

5.1 Personal data is processed exclusively for the purpose of operating, maintaining, and improving the Services.

5.2 This includes enabling users to earn and use tokens, facilitating participation in decentralized infrastructure, ensuring system integrity, preventing fraud or abuse, and complying with applicable legal obligations where necessary.

5.3 OpenEarn does not use personal data for personalized advertising or commercial profiling.

6.1 OpenEarn integrates advertisements provided by third-party providers, including Meta and Google.

6.2 OpenEarn does not personalize advertisements and does not deploy cookies, tracking pixels, or similar tracking technologies within its own platform.

6.3 Users acknowledge that third-party providers may independently process data in accordance with their own privacy policies, which are outside the control of OpenEarn.

7.1 The Services may rely on infrastructure associated with the OpenGPU Network, which utilizes decentralized technologies.

7.2 OpenEarn does not store personal data on any blockchain.

7.3 Wallet addresses used within the system are not linked by OpenEarn to identifiable individuals.

7.4 Personal data is processed off-chain, while blockchain elements are used solely for technical execution and coordination.

7.5 Due to the nature of distributed ledger technologies, certain transaction-related records may be immutable and cannot be modified or deleted.

8.1 OpenEarn processes data relating to token generation, allocation, and usage within the platform.

8.2 This includes tracking user engagement with advertisements and monitoring transactions for system functionality.

8.3 Such data is used solely for internal operational purposes and is not shared with third parties, except where strictly necessary.

9.1 Users may utilize tokens to access artificial intelligence models available through infrastructure associated with the OpenGPU Network.

9.2 These AI services are provided by third-party providers.

9.3 OpenEarn does not store, reuse, or otherwise process user inputs submitted to AI models and does not use such inputs for training purposes.

10.1 Users may optionally contribute computational resources, including GPU or CPU capacity, through their devices.

10.2 This functionality operates through decentralized infrastructure.

10.3 OpenEarn does not access personal files or private data stored on user devices.

10.4 Only technical resource availability is utilized for the purpose of providing computational services.

11.1 OpenEarn shares personal data only where necessary for the provision of the Services.

11.2 This includes sharing data with advertising providers such as Meta and Google, as well as service providers involved in infrastructure or verification processes.

11.3 Data processing may take place in France or other jurisdictions that provide an adequate level of data protection or appropriate safeguards.

11.4 OpenEarn does not sell personal data.

12.1 OpenEarn retains personal data only for as long as necessary for the purposes described in this Privacy Policy.

12.2 Account data may be retained for the duration of the account and for up to five years thereafter.

12.3 Transaction and usage data may be retained for up to seven years.

12.4 Technical logs and security-related data may be retained for up to twenty-four months.

12.5 Retention periods may be extended where necessary to ensure system integrity, prevent fraud, or comply with legal obligations.

15.2 OpenEarn does not actively target minors.
